Privacy and Cookies Policy

1. Identification

1.1. This website is owned and operated by NEXT — Gali Macedo e Associados, Sociedade de Advogados, SP RL (the “Firm”). The Firm is a limited liability professional partnership, headquartered at Avenida da Boavista, no. 1588, 7th floor, 4100-115 Porto, Portugal, tax identification number 507401620, registered with the Portuguese Bar Association under no. 51/05.

1.2. Contact details: phone 220 902 525; general email geral@nextlawyers.com

1.3. Law is a regulated profession. The Firm’s lawyers practise under the professional title of advogado (attorney), granted in Portugal, and are registered with the Portuguese Bar Association, a public professional association. The applicable professional and ethical rules are set out in the Statute of the Bar Association, approved by Law no. 145/2015 of 9 September, and its regulations, accessible at www.portal.oa.pt.

1.4. The Firm holds professional liability insurance, pursuant to Article 104 of the Statute of the Bar Association.

1.5. The information in this clause is provided in compliance with Article 10 of Decree-Law no. 7/2004 of 7 January, and Article 20 of Decree-Law no. 92/2010 of 26 July.

2. Scope and Acceptance

2.1. These Terms govern access to and use of the website www.nextlawyers.com and its content and features.

2.2. Use of the website is subject to these Terms as in force at the time of access. For features requiring express acceptance — such as contact forms — the Terms are deemed accepted upon that action. Anyone who does not accept them should refrain from using such features.

2.3. The Firm may amend these Terms based on legislative or regulatory changes, changes to the website’s features, or security requirements. Amendments are announced on the website with the date of the new version and apply only to subsequent access; where they materially affect users’ rights, they will be announced with reasonable prior notice.

3. Nature of Published Information

3.1. The website’s content — including articles, information notes, legislative commentary, and FAQs — is general and informational in nature.

3.2. Such content does not constitute a legal opinion, legal consultation, or advice regarding any specific situation, and does not replace consultation with a lawyer.

3.3. Published information reflects the law, case law, and administrative practice in force at the time of publication. The Firm assumes no obligation to update it and accepts no liability for any resulting outdatedness.

3.4. The Firm is not liable for decisions made or omissions based solely on information published on the website.

4. Absence of Professional Relationship

4.1. Browsing the website, filling in forms, sending emails, or making telephone contact does not in itself constitute a mandate or establish a professional relationship between the user and the Firm.

4.2. It is the Firm’s policy to accept a mandate or engagement only through a written service proposal accepted by both parties, and after completing conflict-of-interest checks and fulfilling the legally required identification obligations. No prior contact should be construed as acceptance of an engagement.

4.3. Users are advised not to send detailed information about their case through the website or by email before a professional relationship has been established. Notwithstanding the duty of professional secrecy — which binds the lawyer even if the requested service is ultimately not accepted, pursuant to Article 92(2) of the Statute of the Bar Association — knowledge of elements of a matter may preclude the Firm from accepting that engagement due to a conflict of interest, under Article 99 of the same Statute.

4.4. The website and email should not be used for the service of legal proceedings or for urgent or time-sensitive communications. The Firm does not guarantee that messages will be read within any specific timeframe.

5. Ethical Scope of Content

5.1. The website’s content constitutes information about the Firm and its professional activities, disclosed in accordance with the applicable ethical framework.

5.2. Nothing on the website constitutes solicitation of clients, which is prohibited under Article 90(2)(h) of the Statute of the Bar Association, nor is it intended to harm the purposes or reputation of the Bar Association and the legal profession, as provided in Article 91(a) of the same Statute.

5.3. The Firm makes no promises or guarantees of results. References to practice areas, experience, or past matters are presented without identifying clients — except where specific written authorisation has been granted — and do not allow any inference that similar results will be achieved in other cases.

6. Conditions of Use

6.1. The user undertakes to use the website in compliance with the law, these Terms, and good faith.

6.2. The following are expressly prohibited:

a) Automated extraction or collection of content, including through robots, crawlers or scrapers, and its use to build databases, except for indexing by general-purpose search engines;

b) Use of content for training, developing, or validating artificial intelligence systems without the Firm’s written authorisation;

c) Use of email addresses and other contact details published on the website to send unsolicited commercial communications;

d) Introducing viruses or other malicious code, and any act that disrupts the operation of the website or third-party access to it;

e) Attempting unauthorised access to restricted areas, systems, or data;

f) Use of the Firm’s name, trademarks, logos, and other distinctive signs without written authorisation, except as provided in clause 7.2 and as permitted by law.

7. Intellectual Property

7.1. The website’s content — including texts, articles, images, videos, databases, structure, graphic design, and source code — is owned by the Firm or by third parties who have licensed it, and is protected by the Code of Copyright and Related Rights and applicable industrial property legislation.

7.2. Browsing and partial reproduction of content for personal and non-commercial use is permitted, provided that the content is not altered and the source is credited, with reference to the Firm and the website address.

7.3. Any other use — including reproduction for commercial purposes, distribution, transformation, public communication, and full or partial incorporation into other websites or services — requires the Firm’s prior written authorisation.

7.4. The Firm expressly reserves the right to use website content for text and data mining purposes, under Article 75(2)(w) of the Code of Copyright and Related Rights, as amended by Decree-Law no. 47/2023 of 19 June, which transposed Article 4(3) of Directive (EU) 2019/790. This reservation is supplemented by a machine-readable declaration on the website and does not affect the exception provided in subparagraph (v) of the same provision, concerning research organisations and cultural heritage institutions.

8. Links to Third-Party Websites

8.1. The website may contain links to third-party websites and services, provided solely for the user’s convenience. The Firm does not control those websites, does not endorse their content, and is not responsible for them or for the privacy policies they apply.

8.2. Links to the Firm’s website may not suggest a non-existent association, sponsorship, or endorsement, nor may they display the website within frames or other elements of a third-party site without the Firm’s written authorisation.

9.Availability, Security and Liability

9.1. The Firm takes reasonable technical and organisational measures to ensure the operation and security of the website, but does not guarantee uninterrupted availability or the absence of errors, and may suspend access for maintenance or security reasons.

9.2. The Firm is not liable for damages resulting from website unavailability, the presence of viruses or other harmful elements, or unauthorised access to systems, where these are not attributable to the Firm.

9.3. The provisions above do not exclude or limit the Firm’s liability in cases where the law so requires — in particular under Articles 18 and 21 of Decree-Law no. 446/85 of 25 October — nor in cases of wilful misconduct or gross negligence.

10. Contact Forms and Communications

10.1. The forms available on the website are intended for submitting contact and information requests. Completing them does not constitute acceptance by the Firm of any request; clause 4 applies.

10.2. The user warrants the accuracy and currency of the data entered and, when submitting third-party data, that they are entitled to do so and have informed the data subjects.

10.3. The Firm sends informational or commercial communications only to those who have given their consent or with whom an active professional relationship exists. Recipients may opt out at any time, at no cost, via the mechanism indicated in each communication. Article 13-A of Law no. 41/2004 of 18 August applies.

11. Personal Data and Use of Cookies

11.1. The processing of personal data through the website is governed by the Privacy Policy, available at www.nextlawyers.com, drawn up in accordance with Regulation (EU) 2016/679 and Law no. 58/2019 of 8 August. The Firm is the data controller.

11.2. The use of cookies and similar technologies is governed by the Cookie Policy, available at www.nextlawyers.com. Cookies that are not strictly necessary for the website’s operation are used only with the user’s prior consent, pursuant to Article 5(1) of Law no. 41/2004 of 18 August.

11.3. Data subjects may exercise their rights as set out in the Privacy Policy and lodge a complaint with the National Data Protection Commission (www.cnpd.pt).

12. Complaints and Alternative Dispute Resolution

12.1. Complaints concerning the Firm and its services may be submitted in writing to geral@nextlawyers.com.

12.2. Clients may request a fee assessment from the Superior Council of the Bar Association and file a complaint with the Bar Association’s disciplinary bodies (www.portal.oa.pt).

12.3. Where the client is a consumer, and without prejudice to the right to bring the dispute before the courts, the alternative consumer dispute resolution entity with territorial jurisdiction in the area of the Firm’s registered office is CICAP — Centro de Informação de Consumo e Arbitragem do Porto (www.cicap.pt). The Firm has not adhered to this entity. This information is provided voluntarily and the Firm is not bound by any alternative dispute resolution entity.

13. Governing Law and Jurisdiction

13.1. These Terms are governed by and construed in accordance with Portuguese law.

13.2. Disputes arising from use of the website are subject to the jurisdiction of the courts of the district of Porto, without prejudice to mandatory legal provisions on jurisdiction, including those applicable to consumers.

14. Entry into Force

14.1. This version of these Terms has been in force since 1 August 2026 and supersedes all previous versions.
